Welcome to Viviero3D. These Terms of Service (“Terms”) govern your access to and use of viviero3d.com, including purchases, communications, customization requests, and other services provided through the website.

Viviero3D is a brand operated by Viviero LLC, located in Orlando, Florida, United States.

By accessing the website or placing an order, you agree to these Terms and to the policies referenced below.

By using viviero3d.com, you agree to comply with these Terms and all applicable laws and regulations.

You must be legally capable of entering into a purchase transaction or have the authorization of a parent or legal guardian where required.

2. Store and Services

Viviero LLC produces, markets, and sells physical decorative household products under the Viviero3D brand, including planters, pots, vases, plant accessories, stands, wall pieces, and other home decor products.

Unless expressly stated otherwise on the applicable product page, listings are for physical products only.

Plants, soil, flowers, styling accessories, digital files, and 3D model files are not included unless specifically stated.

We may add, modify, suspend, or discontinue products, options, features, or services at any time.

3. Product Information

We make reasonable efforts to present product descriptions, photographs, dimensions, materials, colors, available options, and pricing accurately.

Measurements are approximate unless expressly stated otherwise.

Because of screen settings, lighting, photography, material batches, surface geometry, and manufacturing variations, actual colors and finishes may differ slightly from what appears on a screen.

Viviero3D products are produced using additive manufacturing. Fine layer lines, directional texture, seam placement, and minor surface variations are normal characteristics of the 3D-printing process and are not considered defects when they do not materially impair the intended function of the product.

Customers are responsible for reviewing product dimensions, available options, drainage configuration, intended use, materials, and other listing information before ordering.

We reserve the right to correct typographical errors, pricing errors, inaccurate descriptions, or availability information. If a material error affects an order already placed, we may contact the customer to confirm the correction or cancel and refund the affected order.

4. Orders, Pricing, and Payment

By placing an order, you agree to provide accurate and complete information, including billing information, shipping address, contact details, selected variants, and personalization information.

Prices may change without notice. The price applicable to an order is generally the price displayed when the order is submitted, subject to correction of obvious errors.

Payment is processed through Shopify and the payment methods available at checkout.

An order may be subject to payment authorization, fraud screening, or additional verification.

We reserve the right to refuse, limit, or cancel an order when reasonably necessary because of suspected fraud, payment issues, pricing or inventory errors, production limitations, misuse of the website, or other legitimate business or legal reasons.

Any applicable sales tax or other governmental charge collected at checkout will be displayed before the order is completed.

5. Customization and Customer-Supplied Content

Customization is available only where shown on the product page or separately confirmed by Viviero LLC.

Requests submitted through an order note, email, message, or personalization field do not automatically become part of the order unless they correspond to an available option or are expressly confirmed by us.

Customers are responsible for reviewing submitted text, spelling, capitalization, punctuation, sizes, colors, positions, and other personalization details before ordering.

We may make proportionate layout, spacing, or font-size adjustments when reasonably necessary to produce the requested customization.

By submitting names, phrases, logos, artwork, images, or other content, you represent that you own the content or have permission to use it and that our use of the content for your order will not violate applicable law or third-party rights.

We may decline customization that is unlawful, infringing, unsafe, technically impractical, or inconsistent with our production standards.

6. Order Changes and Cancellations

Cancellation requests should be submitted within 3 hours of purchase.

Because products are made to order, production may begin shortly after that period, and cancellation or modification may no longer be possible.

Requests to change color, size, drainage, personalization, quantity, or shipping information are not guaranteed until confirmed by Viviero3D.

If an approved change increases the cost of the product, production, or shipping, additional payment may be required before the order continues.

Nothing in this section limits any cancellation or refund right that cannot legally be waived.

7. Production, Shipping, and Delivery

Most Viviero3D products are made to order.

Our standard processing time is generally 1–3 business days before shipment, unless a product page, order confirmation, or other written communication states otherwise.

Viviero3D currently ships orders placed through viviero3d.com within the United States only.

Available shipping methods, rates, current shipping destinations, carrier information, tracking procedures, address requirements, and delivery-related terms are governed by our Shipping Policy.

Shipping rates and available delivery methods are also displayed at checkout.

Processing time and carrier transit time are separate.

Delivery dates and carrier transit estimates are not guarantees.

If we determine that an order cannot be shipped within the applicable stated timeframe, we will provide notice and any options required by applicable law.

Customers are responsible for providing an accurate and complete shipping address.

8. Returns, Damaged Items, and Refunds

Return, replacement, and refund eligibility is governed by our current Return & Refund Policy.

Custom or personalized products may be subject to different return eligibility than standard products.

Approved refunds are issued according to the payment and processing procedures described in that policy and any applicable law.

Nothing in these Terms limits consumer rights that cannot legally be waived.

The Viviero3D brand name, original photographs, videos, graphics, written content, website elements, packaging materials, and original product designs created by Viviero LLC are protected by applicable intellectual property laws.

Some products may incorporate properly licensed models, design elements, or other assets created by third parties.

Viviero LLC respects applicable commercial licenses and does not claim ownership of third-party intellectual property.

Purchase of a physical product does not transfer copyright, digital files, manufacturing rights, or any right to reproduce, scan, mold, copy, distribute, or commercially manufacture a protected design.

Website content and product imagery may not be copied, scraped, reproduced, published, distributed, or commercially used without authorization except where permitted by law.

Products are not intended for food contact, medical use, structural or load-bearing applications, or use as children's toys unless specifically stated otherwise.

Customers are responsible for following product-specific instructions relating to mounting, drainage, weight limits, heat exposure, outdoor suitability, cleaning, assembly, and intended use.

Damage caused by misuse, overloading, improper installation, unauthorized modification, unsuitable environmental exposure, or failure to follow instructions is not considered a manufacturing defect.
